@1969sag,

Please don't take this post as being negative, only as somewhat of a warning. I'm pulling for you as I feel you have been wronged, BUT...I've seen too many times where what was right, justified, etc. did not happen. I read from your post that you feel things are going you way (I hope they are and do), but don't be too optimistic in cases like this. If there is no insurance involved (you want there to be), then getting blood out of this turnip, no matter what the verdict, will be difficult at best.

Again, pulling for you, hope it all goes your way.

UPDATE!
Ok. I have to clarify something first.
It was the defendants 1st lawyer that said the insurance would not cover anything.

Today. My lawyer filed the Plaintiffs’ (our) Witness List in court. The attorney that stood in for defense at the last hearing has informed us that they are attempting to have the contractors insurance company step in to cover damages. I will be kept informed. We are moving forward regardless of what they say they are going to do.

Baby steps. Going in the correct direction though.

UPDATE! WE WON!

From my lawyer today.

Attached please find a copy of the Opinion and Order granting our motion to strike and entry of default entered with the court yesterday. We are required by court rule to wait 21 days to allow Defendant time to file any motions for reconsideration. If nothing is filed within the 21 days, our office will file a Motion for Damages in order to determine a dollar amount on the Judgment.

The Judge rules in favor of my lawyers motion that was filed Jan 29, 2018. To grant us a default judgement.
The defendants responce to our lawsuit was considered an admission of guilt in the courts eyes.
The defendents have 21 days to appeal the judges ruling.

NOT LIKELY.

After 21 days. My lawyer will submit a motion for damages.
Then we go after them, and their insurance company to recover the dollar amount the judge awards.

I may also be able to have the county prosecuter file criminal fraud charges against them.

On to the next step.

I suspect that was the “easy” part and getting money out of those dirtbags will be tough.

The lawsuit named the owner and the business name in the lawsuit.
If I have to. I can place liens on both the busines and his personal property.

Joe, I'm happy to hear you finally got some good news. Too bad it had to be drug out for so long. Financially it would have been much cheaper for him to come back and clean up his mess and leave your yard in the state it was in before his arrival. Also hopefully it prevents this douche bag from doing it to someone else.
