Did you folks hear that?
That extremely LOUD CRACK sound? It was like thunder.
That was the sound of the largest Bi*@# SMACK in the world. My lawyers response to their motion.

Today my lawyer filed a Response and Brief to deny, their motion to set aside the default ruling.

It is a world class B Smack. The brief is a thing of beauty to read.

My lawyer responded to all 18 of their allegations, with skill.
Then gave 4 pages of examples of Michigan State Law that support our case.
Then asked the judge to deny thier motion, and immediatly award costs.
Wow.

Maybe their insurance company's not covering them because "they were performing work that ABOSOLUTLEY reuires a Michigan State Builders Liscience. That they told me they did not need." and they're only insured for work they're allowed to do? But that's not your problem. Hope you get paid and fast.....

Update! Meeting with the judge today.
No real new news though.
My lawyer called me this morning to have me email him all my quotes for repairs, and reciepts to date.
Judge is taking the motion to set aside default under advisement (which means he will enter an order within the next couple weeks). My lawyer is pretty sure that it will be in our favor.
My lawyer went over the costs with their attorney and, hopefully, he will get back with us.

Just more time delays.

Now I have to somehow convince the city to extend my building permit, yet again.

It would be real stupid of me to sign a contract, and move forward with construction before the judge awards damages.

I want to appease the city and move forward, but to do so would shoot myself in the foot.
I would also feel a lot more confident about moving forward if I get a judgement.
I will still have to collect. That is just a matter of time because there is a lot of options when it comes to collecting in Michigan.

Just glanced thru this thread. Sorry you got screwed by a POS contractor. Never seen anything like it. I've been in and around construction for 40 years. I've seen hack jobs before but not that scale.
The worst thing remains no garage for your mustang(s)

*UPDATE*

I have not had any new news until today.
I took a few months off this thread because of the worry and stress this long process causes me. So sorry if I haven't updated in a while. I have just been trying to work hard, save money, cruises, and car shows. I also have some health issues that are making life difficult at the moment but nothing life threatening.

Today I got good news. I will try and put it into layman terms.
The judge ruled on 8-31-18. On 2 motions. The defenses motion for the Judge to reconsider his verdict. AND.
Our Motion that the judge throw out the defenses Motion for appeal. Both these motions were DENIED. The judge ruling that his original ruling stands, made our motion unnecessary.

His original April 25th ruling stands. I win.

Now, going forward.
The Defendants, (them). Have another 21 days to enter an appeal of the ruling of this case with the Michigan State Court of Appeals.

That seems HIGHLY unlikely. For many reasons.
Therefore, at the end of 21 days from the date of the Order (August 31, 2018), we will file a motion for damages and hopefully begin the collection process.

Then we will see what the next fight brings.
Thank you all for you support. I really do appreciate it. Sorry, I have not been more talkative about this lately. It fatigues me to think about this too much. Today there was good news.

The past couple of days I have been wondering how things were going. Glad to hear the judge ruled in your favour Joe. Very understandable taking a break from it. Had a health scare myself back in July. Life can change very quickly and unexpectedly. I wish you all the best man.

Good news update, just the kind we all like. I too have been wondering lately how it was going for you...afraid to ask and took the long silence as not a good sign....glad that was not the "case" LOL One day soon you will have a sweet garage back there!
